Return and Refund Policy for Artworks

This document regulates the conditions for the return of purchased oil paintings, prints, framed artwork, and the procedure for cash refunds for goods sold by individual entrepreneur “CHINNI CLASS” MCHJ through www.CHINNICLASSIC.com. This document is an integral part of the public offer.

1. General Provisions
1.1. This Policy applies exclusively to the purchase of physical goods (original paintings, limited edition prints, and framed canvases) available on the Website.
1.2. By placing an order, the Buyer fully and unconditionally accepts the terms of this Policy and the public offer.

2. Return of Physical Artwork
2.1. Right of Withdrawal:The Buyer has the right to return a purchased oil painting or print within **14 (fourteen) calendar days** from the date of physical receipt of the goods.
2.2. Return Conditions:
– The artwork must be in its original, unused condition.
– The artwork must not show signs of hanging, wear, soiling, or damage caused by the Buyer.
– The return must include the original packaging materials (outer box, protective layers, corner protectors) to ensure safe transit back to the Seller.
– All accompanying documentation (Certificate of Authenticity, if provided) must be returned with the artwork.
2.3. Non-Returnable Items:
– Custom-commissioned portraits or paintings created specifically at the Buyer’s request.
– Personalized artworks (e.g., paintings with specific inscriptions or modifications requested by the Buyer).
– Prints that have been removed from their sealed protective packaging or unframed by the Buyer.
2.4. Return Shipping Costs:The cost of return shipping is borne by the Buyer, unless the return is a result of an error by the Seller (e.g., wrong item shipped) or a manufacturing defect.

3. Refund Procedure
3.1. Refunds are issued only after the returned artwork has been received and inspected by the Seller to confirm compliance with the conditions outlined in Section 2.2.
3.2. In the event of a refund approval, the Seller retains the right to deduct actual documented expenses incurred for:
– Initial delivery/shipping costs.
– Payment processing/bank transaction fees.
– Restoration costs, if the artwork was returned damaged due to improper packaging by the Buyer.
3.3. Refunds shall be processed within 10 (ten) calendar days following the positive inspection of the returned item and the decision to issue a refund.
3.4. Refunds are issued using the same payment method originally used by the Buyer, unless otherwise agreed upon in writing.

4. Damaged Goods Upon Delivery
4.1. Upon receiving the courier package, the Buyer is obliged to inspect the external packaging for visible damage in the presence of the courier representative.
4.2. If the oil painting/canvas is visibly damaged during transit, the Buyer must:
– Note the damage on the delivery receipt or refuse delivery outright.
– Notify the Seller within **24 hours** via email or phone, providing clear photo and/or video evidence of the damaged packaging and artwork.
4.3. Failure to document damage at the time of receipt may result in the refusal of a refund claim for transport damage.

5. Grounds for Refusal of Return or Refund
5.1. The Seller has the right to refuse a return or refund request if:
– The 14-day return period has expired.
– The artwork shows signs of use, alteration, or damage that occurred after delivery to the Buyer.
– The Buyer provided incorrect or incomplete delivery address data, resulting in the package being lost or returned to the Seller after failed delivery attempts.
– The item falls under the category of non-returnable goods as defined in Section 2.3.

6. Force Majeure
6.1. In the event of force majeure circumstances (including but not limited to natural disasters, adverse weather preventing safe transport, restrictions imposed by state authorities, or other events beyond the reasonable control of the Seller), the Seller shall be exempt from liability for delivery delays or inability to fulfill the order. The delivery timeframe shall be extended accordingly.

7. Limitation of Liability
7.1. The liability of the Seller is limited to the amount paid by the Buyer for the specific artwork in question.
7.2. The Seller shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit or exhibition opportunities.

8. Dispute Resolution
8.1. All disputes arising from this Policy shall be resolved through good faith negotiations between the Buyer and the Seller.
8.2. The response time for written claims or complaints is 10 (ten) working days from the date of receipt.
8.3. If an agreement cannot be reached through negotiation, the dispute shall be referred to and finally resolved by the competent court at the place of registration of the Seller, in accordance with the legislation of the Republic of Uzbekistan.

9. Final Terms
9.1. This Policy is an integral part of the public offer and applies to all orders placed on www.CHINNICLASSIC.com.
9.2. The Seller reserves the right to amend or update this Policy at any time. The current version is always available on the Website. Changes apply to orders placed after the updated version is published.
