Public Offer (Agreement for the Sale of Goods)

This document is a public offer (quotation) from the individual entrepreneur “CHINNI CLASS” MCHJ (hereinafter referred to as the “Seller”, “Online Art Store”), located at www.CHINNICLASSIC.com (hereinafter referred to as the “Website”), and includes the terms and conditions for the sale of original oil paintings, prints, and framed artwork (hereinafter referred to as the “Goods”).

According to the laws of the Republic of Uzbekistan, payment for an order means full and unconditional acceptance (acceptance) of the terms and conditions of this offer. Please carefully read the terms and conditions before placing an order.

1. Terminology and Definitions

1.1. “Offer” refers to this document published on the Website.
1.2. “Seller” – “CHINNI CLASS” MCHJ, which sells artworks through the Website.
1.3. “Buyer/Customer” – A legally capable individual or legal entity who places an order and makes payment on the Website for the purpose of purchasing Goods.
1.4. “Recipient” – The person designated by the Buyer to receive the delivery of the Goods (if different from the Buyer).
1.5. “Goods” – Physical items available for purchase on the Website, including but not limited to: original oil paintings, canvas prints, framed artwork, and limited edition art reproductions.
1.6. “Order” – A properly executed request by the Buyer for the purchase and delivery of Goods selected on the Website.
1.7. “Personal Account” – A section of the Website accessible to the Buyer after registration, containing order history and personal data management tools.

2. General Provisions

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to accept and pay for the Goods in accordance with the terms of this Offer.
2.2. Descriptions, technical specifications (dimensions, materials, framing), prices, and availability of Goods are listed on the Website and form an integral part of this Offer.
2.3. The visual representation of artworks on the Website may vary slightly from the actual physical product due to monitor color calibration and photographic lighting. Minor deviations in color rendition are not considered defects.
2.4. The Seller has the right to modify the Offer and prices of Goods. The new version takes effect from the date of publication on the Website and applies to Orders placed after the release date.

3. Subject of the Offer

3.1. The subject of this Offer is the retail sale of Goods (oil paintings and art prints) displayed on the Website.
3.2. The Seller guarantees that all Goods are authentic and correspond to the descriptions provided on the product page.

4. Ordering Procedure

4.1. To place an Order, the Buyer selects the desired Goods on the Website, adds them to the “Cart,” and proceeds to “Checkout.”
4.2. The Buyer is required to provide accurate and complete information necessary for order fulfillment, including:

  • Full Name;

  • Contact Phone Number;

  • Email Address (for order confirmation and tracking);

  • Accurate Delivery Address.
    4.3. The Seller is not responsible for delays or non-delivery of Goods resulting from incorrect or incomplete address details provided by the Buyer.
    4.4. The Seller reserves the right to contact the Buyer to confirm Order details or verify the Buyer’s identity.
    4.5. If fraud or misuse of payment methods is suspected, the Seller has the right to cancel the Order and suspend the processing of the transaction.

5. Price and Payment

5.1. The price of Goods is displayed on the Website in the national currency of the Republic of Uzbekistan (UZS).
5.2. Payment for Goods is made on a 100% prepayment basis, unless otherwise agreed in writing.
5.3. The moment of payment is considered the receipt of funds to the Seller’s bank account or confirmed authorization of the payment by the processing system.
5.4. Delivery costs, if applicable, are calculated separately at checkout based on the delivery address and dimensions/weight of the artwork.
5.5. The Buyer bears the costs of any commissions charged by their bank or payment system for the transaction.

6. Delivery of Goods

6.1. Delivery of Goods is carried out by courier service or postal service to the address specified by the Buyer.
6.2. Delivery timelines are estimates provided by the courier partner and begin upon confirmation of payment and packaging of the artwork.
6.3. Upon receiving the Goods, the Recipient (or Buyer) is obliged to inspect the external packaging for visible damage in the presence of the courier representative. In the event of damage, the Recipient must note this on the delivery receipt or refuse delivery.
6.4. The Seller’s obligation to deliver is considered fulfilled at the moment the Goods are handed over to the Recipient (or the courier service representative at the designated address).
6.5. If the Buyer fails to accept delivery for reasons not attributable to the Seller (e.g., absence at the specified address during repeated delivery attempts), the Goods may be returned to the Seller. Re-delivery in such cases is at the Buyer’s expense.

7. Return and Exchange of Goods

7.1. Right of Withdrawal: The Buyer has the right to refuse the Goods and request a refund within 14 (fourteen) calendar days from the date of physical receipt, provided the Goods retain their original condition, consumer properties, and original packaging.
7.2. Non-Returnable Items: In accordance with the legislation of the Republic of Uzbekistan, custom-made portraits, personalized paintings, and Goods created specifically for the Buyer’s order cannot be returned or exchanged.
7.3. Return Procedure: The Buyer must notify the Seller in writing via the contact details provided in Section 14 and arrange for the return shipment. Return shipping costs are borne by the Buyer unless the return is due to a Seller error (e.g., wrong item shipped) or a manufacturing defect.
7.4. Refund Timeline: Refunds are processed within 10 (ten) calendar days after the Seller receives and inspects the returned Goods.

8. Intellectual Property

8.1. All images, texts, and visual content displayed on the Website are the intellectual property of the Seller or respective artists and are protected by copyright law.
8.2. The purchase of an original oil painting does not transfer copyright or reproduction rights to the Buyer. Commercial use of the image of the purchased artwork requires a separate written agreement with the rights holder.

9. Responsibilities of the Parties

9.1. The Seller is responsible for the transfer of Goods of proper quality and the fulfillment of delivery obligations as specified in this Offer.
9.2. The Seller is not liable for:

  • Minor color discrepancies due to monitor settings.

  • Delays in delivery caused by the courier service or circumstances of force majeure.

  • Damage to the Goods occurring after the moment of delivery to the Buyer/Recipient.
    9.3. The total liability of the Seller is limited to the amount actually paid by the Buyer for the specific Order in question.

10. Personal Data

10.1. By placing an Order, the Buyer consents to the processing of their personal data by the Seller for the purposes of fulfilling the Order, delivery, communication, and complying with legal requirements.
10.2. The Seller may transfer the Buyer’s data (Name, Phone, Address) to the courier service solely for the purpose of executing delivery.
10.3. Personal data processing is carried out in accordance with the Privacy Policy published on the Website.

11. Force Majeure

11.1. The Parties are exempt from liability for partial or complete failure to fulfill obligations if such failure is a result of force majeure circumstances (natural disasters, military actions, restrictions imposed by state authorities, etc.).
11.2. The deadline for fulfilling obligations is extended proportionally to the duration of the force majeure event.

12. Validity Period of the Offer

12.1. The Offer is valid indefinitely until withdrawn or replaced by a new version published on the Website.
12.2. The contract for the sale of Goods comes into effect from the moment the Buyer accepts the Offer (completion of Order payment).

13. Dispute Resolution

13.1. All disputes shall be resolved through a claim procedure. The Buyer may send a written claim to the Seller’s email address specified in Section 14.
13.2. The response time for claims is 10 (ten) working days.
13.3. If an agreement cannot be reached, the dispute shall be resolved in a court at the place of registration of the Seller in accordance with the legislation of the Republic of Uzbekistan.
